INTERPRETATION AND DEFINITIONS

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

(vi)Financial and/or economic Information such as your credit card or debit card Information and Other Information you may provide at the time of purchase.

WHY & HOW WE COLLECT YOUR PERSONAL INFORMATION

Nosso Apparel collects your Personal Information through several sources. You provide Personal Information to us through our website when you purchase, register, or return a product; when you sign up for a customer account; and when you contact our customer service center, whether it is by phone, email, chat, or regular mail; when you post Information through our social media sites; or when you sign up to receive emails and newsletters. We also collect your Personal Information when you purchase, register, or return a product via our website; register products by mail; contact our customer service center by phone or letter; submit a warranty claim, or bring your product in for service.

When you visit our website, we track and collect Information that does not personally identify you but helps administer the site, analyzing trends, tracking user movements, and gathering broad demographic Information for aggregate use. This Information includes

INFORMATION SHARED WITH THIRD PARTIES

Nosso Apparel DOES NOT sell or trade Personal Information. With your consent, Nosso Apparel will only use or disclose your Personal Information to a third party for use in a manner consistent with the purposes provided in Section “WHY AND HOW WE COLLECT YOUR PERSONAL INFORMATION” Of this Policy.

Nosso Apparel may share your Personal Information with third-party service providers to provide services on your behalf. These third parties include distributors, authorized dealers, sales representatives, service providers, or other businesses with whom we have partnered to provide a product or service to you. These third parties may need access to Information about you or the products you purchased to address product-related issues and/or provide warranty services.

In addition, we may provide Information to banking and financing partners who issue Nosso Apparel branded credit cards or provide financing for purchasing our products.

Nosso Apparel may share your Personal Information with companies that provide support services, such as marketing consultants, printers, web hosting providers, call center/chat providers, payment processors, shipping services providers, or other third parties that help us market our products and services. CHILDREN’S ONLINE PRIVACY PROTECTION ACT (“COPPA”)

Another part of our priority is adding protection for children while using the internet. We encourage parents and guardians to observe, participate in, and/or monitor and guide their online activity.

Nosso Apparel does not knowingly collect any personally identifiable information from children under the age of 13. If you think that your child provided this kind of information on our website, we strongly encourage you to contact us immediately and we will use our best efforts to promptly remove such information from our records.

(CCPA) CALIFORNIAN CONSUMER PRIVACY

This Statement applies solely to California consumers and addresses personal Information we collect online and offline. This Statement does not apply to Nosso Apparel personnel or job applicants.

This Statement uses specific terms that have the meaning given to them in the California Consumer Privacy Act of 2018 and its implementing regulations (the “CCPA”).

NOTICE OF COLLECTION AND USE OF PERSONAL INFORMATION

SALE OF PERSONAL INFORMATION

We do not sell your personal Information in exchange for monetary consideration. We may allow certain third parties (such as online advertising services) to collect your Personal Information via automated technologies on our website in exchange for non-monetary consideration. We share the categories of Personal Information listed below for online advertising purposes and e-commerce and to provide third-party social network features and functionality on our website. You have the right to opt out of this disclosure of your Information, which may be considered a “sale” under California law, via cookie management in the privacy preference centers of each platform listed above.

That said, due to technical limitations and in the interest of the users, we do not necessarily know the identities of all visitors to our platforms at all times based on the settings they adopt. Your opt-out of cookies setting would only apply to the browser and device you are currently using, as we do not make any attempts to link devices you use. If you clear cookies or use a new browser or device, your opt-out cookie may no longer be available. As a result, in those situations, we may still ask that you authorize the “sale” of your Personal Information when you visit our platforms by asking you to accept cookies within 12 months after you opt out of the “sale” of your Information.

During the 12 months before the effective date of this Statement, we may have “sold,” to the extent “sale” under the CCPA is interpreted to include advertising technology activities, the following categories of Personal Information about you to online advertising services and social networks:

Our websites are not directed at minors, and we do not knowingly collect, much less sell, any personal information from children under the age of 16 through our websites. You have certain choices regarding your Personal Information, as described below.

Access

You have the right to request certain Information about our collection and use of your personal data over the past 12 months. In response, we will provide you with the following Information:

Suppose we have disclosed your personal data to any third parties for a business purpose over the past 12 months. Deletion

You have the right to request that we delete the personal data that we have collected about you. Under the CCPA, this right is subject to certain exceptions. For example, we may need to retain your data to provide you with the services or complete a transaction or other action you have requested. If your deletion request is subject to one of these exceptions, we may deny your deletion request.

 

Personal Data Sales Opt-Out and Opt-In

In this Section, we use the term ‘sell” as it is defined in the CCPA. Over the past 12 months, we have not sold any personal data to third parties. We also do not sell the personal data of minors less than 16 years of age.

  • You also have the right to request that we provide you with (a) a list of specific categories of Personal Information we have disclosed to third parties for their direct marketing purposes during the preceding calendar year and (b) the identity of those third parties.

HOW TO SUBMIT A REQUEST

Please understand that we cannot delete personal Information in those situations where our retention is required for Business Purposes, as detailed above. In these situations, we will retain your Information under our records retention program and securely delete it at the end of the retention period.

We do not offer financial incentives for collecting or selling personal Information. However, we may provide individuals with the opportunity to receive coupons or discounts via email. Suppose you ask us to delete your Information. In that case, we will not be able to send you additional coupons or discounts via email. However, coupons or discounts sent to you previously will continue to be honored according to their original terms. We will not discriminate against you if you exercise your rights under CCPA.

To the extent advertising technology activities (e.g., online advertising, e-commerce, and related tools) are interpreted as a “sale” under the CCPA, please visit the cookie preference center when you first visit a Nosso Apparel site to opt-out of such sales. You can update your preferences at any time via the Manage Cookies link in the page footer of the same site. We collect pseudonymized or aggregated data, e.g., shortened I.P. addresses, to analyze our websites’ use and improve and optimize the websites and display advertising tailored to your needs. We collect this data (to improve your website experience and to promote our products and services) via OneTrust, a cookie management tool.

To submit a request as an authorized agent on behalf of a consumer, please send an email from your own email address to sales@Nossoapparel.com indicating your agent’s name and email address. We will respond to requests using both your email address and the agent’s email address. The request must provide enough Information for us to reasonably verify that you are the authorized representative of the person we collected personal Information. WEB CONTENT ACCESSIBILITY GUIDELINES (WCAG) 2.1

Nosso Apparel (the “Company”) is committed to ensuring full and equal access to the goods, services, facilities, privileges, advantages, and accommodations provided by and through its websites (“Websites”) through effective communication based on the Web Content Accessibility Guidelines 2.1 Level A and AA Success Criteria (the “WCAG 2.1”) from the Web Accessibility Initiative of the World Wide Web Consortium for all customers, potential customers, guests and their companions (collectively, “Customers”) with disabilities.

 

Maintenance of Policy: Nosso Apparel will review, update and maintain this Website’s Accessibility Policy annually or more frequently.

 

Version: This Website Accessibility Policy is effective as of December 2023 and supersedes all prior understandings hereof.

Responsibility and Ownership of this Policy: The commitment and ownership of this Website Accessibility Policy will be assigned to the Web Accessibility Coordinator.

Distribution of Policy: Nosso Apparel will, on an annual basis or more frequently, distribute this Website Accessibility Policy to all employees and contractors responsible for website content and technical support related to Company Websites. This Website Accessibility Policy will be maintained and made available to affected Company employees and contractors in the same manner as similar policy documents affecting Company operations and Customer interaction.

Website Accessibility Training: Nosso Apparel will, on an annual basis or more frequently, provide training to website content personnel on how to achieve effective communication and conform website content to the WCAG 2.1. Website content personnel shall also receive this training when hired into a position that includes such a role.

Web Accessibility Coordinator: Nosso Apparel will designate an employee as Nosso Apparel LLC’s Web Accessibility Coordinator:

  • The Web Accessibility Coordinator will be knowledgeable with the requirements of Title III of the ADA, the WCAG 2.1, and website accessibility generally;
  • The Web Accessibility Coordinator will hold the ultimate responsibility for ensuring Nosso Apparel LLC’s compliance with this Website Accessibility Policy;
  • The Web Accessibility Coordinator will report directly to the Executive Owner;
  • The Web Accessibility Coordinator will involve the appropriate Company departments in discussions and analyses regarding the website content accessibility.
  • The role, identity, existence, and contact information for the Web Accessibility Coordinator will be publicized to employees, contractors, and Customers in the ordinary channels relating to website access and use.

Automated Website Accessibility Testing: Nosso Apparel will perform automated accessibility tests of its Websites at least once annually to identify any instances where it does not conform to WCAG 2.1. The results of this testing will be provided to the Web Accessibility Coordinator to be evaluated and addressed.

User Accessibility Testing. Nosso Apparel will perform, on an annual basis or more frequently, testing for its websites’ usability by individuals with different disabilities, including, at a minimum, individuals who are blind or have low vision. These individuals are deaf or hard of hearing, and individuals have physical disabilities affecting manual dexterity (such as those limiting the ability to use a mouse). Testing shall include the use and access to the primary features of Nosso Apparel LLC’s Websites, such as the creation of an account, logging in to an existing account, viewing goods, selecting items, and placing them in the virtual shopping cart, checking out and paying for items in the virtual shopping cart, and scheduling delivery or pick-up. The results of this testing will be provided to the Web Accessibility Coordinator to be evaluated and addressed.

Website Accessibility Consultant: Nosso Apparel shall retain an accessibility consultant knowledgeable about the Website’s accessibility, development, structure, and testing to serve as a resource for Nosso Apparel LLC’s existing development infrastructure. The Website Accessibility Consultant will provide Nosso Apparel advice on the following:

  • Achieving WCAG 2.1 AA conformity for Nosso Apparel LLC’s Websites;
  • Testing protocols, methodologies, and results in analysis;
  • Internal Development Guideline best practices for ensuring the development, maintenance, and updating of Website content that conforms to WCAG 2.1 AA standards and achieves effective communication;
  • and Company development team training to achieve conformity with WCAG 2.1 AA standards and effective communication.

Development Guidelines: Nosso Apparel shall create, maintain, and update Website Development Guidelines that mandate effective communication through conformity with WCAG 2.1 AA standards where technically feasible. The Development Guidelines shall treat the elimination of bugs that create accessibility barriers, including those that generate nonconformance with WCAG 2.1 AA, with the same priority level (e.g., speed, resources used to remediate) as any other equivalent loss of function for individuals without disabilities.

Complaint and Policy Modification Request Channel: Nosso Apparel shall provide an email and telephonic communication channel for its Customers to complain about the accessible features of the Websites to request for Nosso Apparel to modify an existing policy. This complaint/modification request channel shall be prominently displayed and directly linked from the Websites’ homepages, with a statement of Nosso Apparel LLC’s policy to ensure that persons with disabilities have full and equal enjoyment of the goods, services, facilities, privileges, advantages, and accommodations of Nosso Apparel through its Websites. The Websites homepages shall include an email address and a telephone number where customers with disabilities experiencing technical difficulties with the Website can request assistance. Nosso Apparel will establish and maintain procedures to evaluate all disabled access-related requests for a new service or modify an existing service to accommodate a Customer’s needs. Nosso Apparel will assess such recommendations based on the Customer’s requirements and disability and take action to fulfill such requests, propose an alternative, or, if appropriate, deny the request. Company agents will promptly communicate all website content complaints and policy modification requests to the Web Accessibility Coordinator, who will maintain and keep records of such requests. The Web Accessibility Coordinator will review such requests to ensure they are reasonably, promptly, and effectively responded to.

Third-Party Content: Suppose Nosso Apparel uses or integrates third-party plug-ins or content in its Websites. In that case, Nosso Apparel shall obtain reasonable representations, warranties, and assurances from third parties that the provided content conforms to WCAG 2.1 AA standards, and/or Nosso Apparel shall undertake reasonable efforts to test and confirm that such content conforms to WCAG 2.1 AA standards.

VERIFYING REQUESTS

To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your personal Information or complying with your request. If you have an account with us, we may verify your identity by requiring you to sign in to your account. Suppose you do not have an account with us and request access to or deletion of your personal Information. In that case, we may require you to provide additional Information reasonable enough to verify your identity.

In addition, if you do not have an account and you ask us to provide you with specific pieces of personal Information, we may require you to sign a declaration under penalty of perjury that you are the consumer whose personal Information is the subject of the request.

  2. b) in the case of Information provided by employees, information necessary for making promotions, appointments, or other employment decisions. For certain more sensitive Personal Information (which may include race, gender, religion, medical Information, etc.) Nosso Apparel will provide an affirmative or explicit (opt-in) choice if the personal Information is to be disclosed to a third party for use in a manner incompatible with the purpose for which it was collected.
